Fluentist is a beta/early access vocabulary learning platform. Features, functionality, pricing, and availability may change at any time without notice. We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time for any reason.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We make no guarantees regarding: (a) AI accuracy or quality, (b) learning outcomes or results, (c) exam success or performance improvement, (d) service availability, reliability, or security, (e) fitness for any particular purpose. You use this service entirely at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY SWISS LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You are responsible for maintaining account security and all activities under your account. You agree to use the service only for lawful purposes and in accordance with these terms. We reserve the right to suspend or terminate your account at any time for any reason, with or without notice.
Pricing is subject to change at any time. Beta pricing and early adopter discounts may be modified or removed without notice. See our Refund Policy for information about payments. Subscription fees are billed in advance and are non-refundable except as required by applicable law.
Free trials are provided to evaluate the service before payment. No payment information is required during the trial. At the end of the trial, you must purchase a subscription to continue using paid features. Trial terms may be modified at any time.
All content, features, and functionality are owned by us and protected by copyright and other intellectual property laws. You retain ownership of your vocabulary lists and personal data, but grant us a license to use, process, and display your content to provide the service.
The service uses third-party AI providers and other services. We are not responsible for the performance, accuracy, availability, or privacy practices of third-party services. Your use of third-party services is at your own risk.
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, violation of these terms, or violation of any rights of another person or entity.
We may terminate or suspend your access immediately, without prior notice, for any reason including breach of these terms. Upon termination, your right to use the service ceases immediately. You may cancel your subscription at any time, but no refunds will be provided for the current billing period.
These terms are governed by Swiss law. Any disputes must be resolved individually (no class actions or consolidated proceedings). Disputes shall be subject to the exclusive jurisdiction of the courts of Switzerland. You waive any right to trial by jury.
As beta software, the service may contain errors, bugs, or interruptions. Features may be incomplete or change without notice. Data loss may occur. We recommend maintaining backup copies of any important data. Beta features are provided for testing and feedback purposes only.
Your use of the service is also governed by our Privacy Policy. By using the service, you consent to data collection and use as described in the Privacy Policy.
These terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Fluentist regarding the service.
